Scope of application

The following conditions of participation apply to your registration/booking and participation in the tournament organized by us, TV 1862 Bensheim e.V. (hereinafter TV Bensheim), from 25 to 26.05.2024, in the sports competition (badminton) and are accepted by you as a participant/orderer as binding.

You can find more detailed information on the sports competitions on the Team Cup Bensheim homepage in the respective sections. In addition, the house rules and their respective supplements for the respective sports facilities apply, insofar as they can be viewed there.

Registration

You can register for the Team Cup Bensheim 2025 via our online registration tool.
One registration per team is required, naming the team members.
The following deadlines apply for registration
20.06.2025, 20:00 (closing of registration/application)

It is possible to close individual classes earlier if they are fully booked in advance. We will offer waiting lists for each game class.

If it is still possible to book leagues after 20.06.2025, we will inform you on our homepage.

On 22.06.2025 we will send you the final information about the Team Cup Bensheim 2025 for your participation by e-mail to the e-mail address provided in the booking process. If you do not receive this, you must contact us from 23.06.2025 via the e-mail: badminton@tv-bensheim.de. Please also note the information that can be found on our homepage.

It is not possible to participate in more than one league as they take place in parallel.

Participation fees

The participation fee per team is 50EUR.

Booking

The sports competition to be selected in the online registration tool is merely an invitation to you, the purchaser, to submit an offer to us to conclude a contract. By clicking on the button “Register with obligation to pay” in the last step of the registration process, you, the customer, submit a binding offer to conclude a contract with us, TV Bensheim (booking).

The participation fees are due immediately after booking and can be paid by bank transfer. A bank transfer is only possible from countries that belong to the euro zone. Otherwise, considerable fees will be charged to the participants.

The registration/booking is only valid once the payment has been received in our bank account and the participation/booking has been confirmed by us by e-mail.

The contract is concluded between us upon receipt of this e-mail.

Reference to the non-existence of the right of withdrawal

In accordance with § 312 g para. 2 sentence 1 no. 9 BGB, there is no right of withdrawal when booking our sports competition.

Cancellation/modification/refund by participants

For cancelations and changes please contact us by e-mail: badminton@tv-bensheim.de.
Cancellations and changes only become effective once they have been confirmed by us by e-mail.

If you cancel your participation after your binding registration/booking, you will receive 50% of the participation fee back if you cancel by 01.05.2024.

Otherwise, in the event of non-participation/non-appearance at the sports competition booked by you, there is no entitlement to reimbursement of the participation fee, unless the cause of this is based on injury to life, body or health caused by us, on a breach of essential contractual obligations or on intentional or grossly negligent fault on our part or that of our vicarious agents or a statutory right of withdrawal exists.

Miscellaneous

Your competition results and, if applicable, the starter lists will be published on our homepage and, if applicable, on the respective homepage of the sports association and external organization service provider.

The punctual appearance of your team at the sports competition is a prerequisite for a smooth process. You must comply with the instructions of the competition supervisors.

There are currently no coronavirus restrictions. Nevertheless, we recommend that you keep your travel and hotel bookings flexible.

Participation requirements

Participation in sports competitions requires all team members to be medically fit. You, as a participant, must have your medical fitness confirmed by a doctor prior to participation, which must not be older than one year at the time of the sports competition. If this is not done and you suffer an injury or other damage to your health as a result of your lack of medical fitness during the sports competition, you cannot assert any claims against us or our vicarious agents. Possible insurance claims remain unaffected by this.

Cancellation

We reserve the right to change the schedule of the competition at short notice, insofar as this is necessary and the overall character of the respective competition is not significantly affected by this. This does not entitle you to withdraw from the contract, to reduce the participation fee or to assert claims for damages.

Liability

Participation in the events is always at your own risk. The liability of us, TV Bensheim, and our vicarious agents is excluded to the extent permitted by law and is limited to damages caused by intent or gross negligence. The above limitation of liability does not apply to damages resulting from injury to life, body or health that are based on a negligent breach of duty by us, TV Bensheim, or an intentional or negligent breach of duty by one of our vicarious agents.

We expressly advise you not to bring any valuables to the events. We do not assume any guarding or duty of care for any valuables brought in. Depositing money or valuables in the lockers provided in the sports facilities/event rooms does not create any obligations on our part with regard to the items you bring in.

Data protection

For completed registrations/bookings, we collect and use personal data from you, the participants, in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details of your rights can be found in our privacy policy.

During the event, photos and videos will be taken showing individuals or groups. These photos will be used by TV Bensheim for reports on the sporting events of the Team Cup Bensheim. If a team member does not wish to appear in a photo, you can object to this by sending an e-mail to badminton@tv-bensheim.de, for example.

Reference to EU dispute resolution platform

The European Commission provides a platform for online dispute resolution (OS). You can find the platform at http://ec.europa.eu/consumers/odr/.

Consumer arbitration

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Severability clause

Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions and the contract as a whole. The invalid provision shall be replaced by the statutory provisions.
